EU Regulatory Landscape

One obligation applies to every company today; two more phase in as you grow.

European Union regulations increasingly require companies to measure, report, and act on workforce risk and social metrics. ClimaHQ is designed to help you meet these requirements with data you already collect through pulse surveys, statutory evaluations, and HRIS integrations.

Psychosocial Risk Evaluation

In force since 1995 under Ley 31/1995 and RD 39/1997. Applies to every company with employees, no size threshold.

What It Requires

Every employer must evaluate psychosocial risk (workload, autonomy, harassment exposure, work-life conflict) using a validated instrument, and the evaluation must be signed by an accredited professional operating through an accredited service.

What ClimaHQ Generates

ClimaHQ runs the FPSICO 4.0 or CoPsoQ-ISTAS21 instrument as a statutory campaign, scores results against each instrument's published norms, reports by workplace, and routes the signature to a matched accredited professional. ClimaHQ is the software and matching layer; it does not perform or certify the evaluation itself.

The Signature Requirement

A qualified professional signs, not ClimaHQ. Any page implying an employer reaches compliance alone in-app would be a misrepresentation; use the Directory to find an accredited partner.

Pay Transparency Directive

First employer reports are due 7 June 2027, on calendar 2026 data.

What It Requires

Organizations with 250 or more employees report gender pay gaps annually starting 7 June 2027; 150 to 249 report every three years from the same date; 100 to 149 join from 7 June 2031. Workers gain the right to request pay information for equivalent roles. Job postings must include salary ranges.

What ClimaHQ Generates

ClimaHQ produces Pay Transparency reports by combining HRIS pay band data with demographic information. Reports include mean and median gender pay gaps, pay band distribution by gender, and intersectional breakdowns where data permits.

Timeline

7 June 2026 was the deadline for EU Member States to transpose the directive into national law, not a reporting deadline for employers. The report due 7 June 2027 is calculated on calendar 2026 data, which is being generated right now, so organizations should begin collecting it today.

CSRD S1: Social Reporting

Workforce indicators for sustainability reporting.

What It Requires

The Corporate Sustainability Reporting Directive (CSRD) requires large companies to report on social and environmental metrics. The S1 standard covers 'Own Workforce': diversity, working conditions, and social governance indicators.

What ClimaHQ Generates

ClimaHQ exports CSRD S1-ready data including workforce composition by gender and age group, employee satisfaction indicators derived from pulse surveys, and psychological safety metrics as a proxy for working conditions.

Most ClimaHQ Customers Are a Data Source, Not a Direct Filer

CSRD's own reporting obligation applies directly only to large companies and listed SMEs above specific size thresholds. Most of ClimaHQ's customers, being smaller employers, encounter CSRD indirectly: as a data request from a larger customer that must report on its own value chain. Organizations that clear the size thresholds themselves face the direct obligation and should treat this section accordingly.

EU AI Act

Why ClimaHQ is zero-risk under the AI Act.

AI in HR is high-risk, and emotion inference is prohibited

The EU AI Act classifies AI systems used in employment, worker management, and access to self-employment as high-risk (Annex III, paragraph 4), and Article 5(1)(f) separately prohibits inferring emotions of a person in the workplace outright. That second clause is the one that matters for ClimaHQ, since burnout risk and belonging scores are exactly the kind of feature it targets. Our out-of-scope analysis rests on the AI system definition in Art. 3(1) and Recital 12, which excludes systems based solely on rules defined by natural persons: because the scoring is deterministic rather than inferred, the system is not in scope of the Act, and neither prohibition applies.

ClimaHQ Uses Zero AI

ClimaHQ's analytics are 100% deterministic. Scores are computed from weighted averages. Predictions use deterministic weighted scoring with full transparency. Topic extraction uses statistical text analysis (TF-IDF). There are no neural networks, no large language models, and no opaque algorithms. The entire regulatory burden of the AI Act simply does not apply.

What ClimaHQ Generates

A signed memo confirming that ClimaHQ analytics fall outside the AI Act definition of an AI system, for internal recordkeeping and to share with auditors or regulators on request. This is a factual memo, not a formal regulatory conformity declaration or filing.

Report Lifecycle

Every compliance report follows a four-stage workflow.

Draft

Reports are generated automatically at the end of each reporting period. Draft reports can be reviewed and edited before submission.

In Review

Move a report to 'In Review' when it's ready for internal stakeholder review. The report is locked from automatic updates at this stage.

Submitted

Mark a report as 'Submitted' after filing with the relevant authority. The report becomes read-only.

Archived

Old reports are archived for audit trail purposes. All archived reports remain accessible.

Equity Dashboard

Detect pay and culture equity gaps across demographics.

How It Works

The Equity Dashboard runs statistical tests (t-tests and effect size calculations) across gender, ethnicity, and department groupings. It surfaces statistically significant gaps in culture scores and compensation data.

Intersectional Analysis

Beyond single-variable comparisons, ClimaHQ can detect gaps at intersections. For example, pay differences affecting women of a specific ethnicity in a specific department. Intersectional analysis requires sufficient data in each sub-group (above the anonymity threshold).
